Subject: FCA Hearing Wednesday, 19 December 2007

Note from Fredrick Töben

1. Mr Prince, for Jeremy Jones, wished to submit an Affidavit of Jones and another from Jones’ solicitor, Steven Lewis, that the matter now be taken to the FCA Registrar for investigation. Leave was granted to serve this material on me by the end of January 2008.

2. I explained to Justice Moore why I had stopped deleting the material. The AJN article indicated that I had apologized for my beliefs. Justice Moore stated quite clearly that the Court Order was a matter between me and the Federal Court of Australia, and that it did not go towards my held beliefs, etc.

3. The matter will be heard again on 28 February 2008.

4. I have decided to continue deleting the material and I am placing a notice on our website:

>>My apology was to the Court and to the Court alone for any possible breach of Branson J Orders that may have occurred. It was never an apology about my views on any undisputable historical facts established by Revisionists and non-Revisionist historians. Accordingly all material complained of has been deleted from the website<<

I sensed again that Justice Moore really tried to get the point across to me that Jones has slipped out of the equation and now it’s between me and the court, a battle that I would lose – and that it serves no purpose in my going to jail.
